What is Medical Malpractice?

Medical malpractice occurs when a victim suffers death, injury or serious permanent damage that occurs due to medical treatment. Medical malpractice must be caused by a failure for a doctor to meet the minimum standard of medical care that is offered by doctors within a given field.

Claims of malpractice may be brought against doctors, surgeons, nurses, and all other types of physicians or the hospital itself. Types of injuries or serious permanent damage may include delayed or missed diagnosis, improper care, medication errors, surgical errors or improper nursing care.

Common forms of medical malpractice are:
