Contract Parties

First Party: The first party in the contract is the one who acquires a right (the creditor).

Elements of the Contract

The elements of a contract are three:

  1. Consent
  2. Subject Matter
  3. Cause

If consent is not present, for instance, if one party to the contract lacks consent, the contract is considered void. A contract formed under coercion of one of the contracting parties is also deemed invalid. How to File for Divorce

  • Submitting the Divorce Request: First, the divorce request must be submitted to the Family Guidance Department of the court in the emirate where one of the spouses resides.
  • Family Guidance Meeting: After submitting the request, an appointment will be scheduled with a family guidance counselor to discuss the possibility of reconciliation between the spouses and to reconsider the decision to divorce. If both parties agree to reconcile, a settlement agreement based on mutual understanding will be drafted, and the wife may return to her husband.
  • Proceeding to Court: If reconciliation is not possible and one party insists on divorce, the family guidance counselor will refer the case to the court.
  • Court Proceedings: Both spouses, or their representatives, will appear before the court. Each party will present their evidence against the other and defend their position until a judgment is issued in the case
